I am a patient navigator (“Patient Navigator”) in a Patient Navigation Program (“PNP”). The goal of the PNP is to improve abortion patients’ experience with accessing abortion care by strengthening the connections between support organizations to minimize information and navigation burdens on patients, maximize patient preference, and ensure that all patients can access the timely care they need. Power to Decide will provide me with access to the digital platform that contains a comprehensive directory of clinics that provide abortion services (such platform, “Navigate”), in support of the goal of the PNP. As part of its involvement, I am committed to following all laws and regulations that apply to the PNP.

As a Patient Navigator, I understand that my role is to support higher-needs abortion patients who need more assistance accessing care than might typically be provided by my site. In the course of supporting these patients, I understand that I may gain access to another clinic’s competitively sensitive information and need to share the same for the site(s) I staff.

I agree that in the course of my work, I will:

Provide information only as needed to help patients understand their best options.
Ensure that patients are informed of all qualified health centers that offer abortion services that meet the patients’ geographic, timing, and economic needs.
Keep any competitively sensitive information in a private location where others in my facility cannot see or access it.
Disclose to patients seeking abortion services:
- They are free to choose any provider.
- We use the website abortionfinder.org (“abortionfinder.org”) and Navigate to identify clinics that offer abortion services in their area based on their location, age, and the first day of their last period.
- We will give them a list of the clinics that are available to provide abortion services to them and will work with them to select a clinic that meets their geographic, timing, service type, and economic needs and preferences. abortionfinder.org and Navigate are operated by a third party.
- No clinic pays a fee to be included on abortionfinder.org or Navigate.
Use Navigate and abortionfinder.org in accordance with their respective terms of use.

I further agree that I will not:

Use information I learn about other clinics for any purpose other than assisting patients. share information on the cost of services anywhere other than with the patient, as necessary to coordinate services.
Coordinate with anyone, follow any general rule, or refer to any tracking information to determine how many or how often patients may be referred to a particular facility or clinic.
Become involved in negotiating payment rates with any payors. accept any remuneration or gifts from any facility or organization that is part of the PNP or to which I refer patients.
Make a patient’s transportation funding contingent on their selection of a particular clinic.
Keep track of where patients are going for care, unless needed to monitor the success of the PNP or for quality assurance purposes.
Refer to patient tracking information to determine what information to provide to a patient or to determine which clinic or facility is appropriate for the patient.
Enter in Navigate, or otherwise disclose in the course of my work through Navigate, any individually identifiable information about patients.
Download the information listed in Navigate or otherwise infringe any of the intellectual property located therein.
Violate the laws or regulations of any applicable jurisdiction.

I agree to the following terms:

I will not represent that I am speaking on behalf of Power to Decide, with respect to Navigate or otherwise, and if I am contacted by any individual or organization with questions about, or seeking a comment regarding, Navigate, then I will not answer the question or provide any comment and I must refer such individual or organization to Power to Decide.
I will not hold Power to Decide responsible for any damages that result, directly or indirectly, from my use of Navigate, for any reason. In no event will Power to Decide or its affiliates, or any party involved in creating, producing, or delivering Navigate be liable for any damages arising out of my access, use, misuse, or inability to use Navigate or any linked sites, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, or line or system failure. In the event I have a dispute with another user related to the use of Navigate, I release Power to Decide from any claims, demands, and damages arising out of such a dispute. These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Power to Decide has been advised of the possibility of such damage. In jurisdictions that do not allow a full limitation of damages, Power to Decide’s liability in such jurisdictions shall be limited to the extent permitted by law.
I will indemnify Power to Decide and its officers, directors, owners, employees, agents, information providers, affiliates, partners, and licensors (the “Power to Decide parties”) against, and hold the Power to Decide parties harmless from liability, losses, costs, and expenses (including attorney’s fees) incurred as a result of my breach of these terms or gross negligence or willful misconduct in my use of Navigate or claims made in connection with such use.
Navigate is provided “as is.” Power to Decide makes no representation or warranty of any kind whatsoever relating to Navigate, user submissions, or other content that may be accessible directly or indirectly through Navigate. Power to Decide disclaims to the maximum extent permitted by law any and all such representations and warranties.
Power to Decide’s failure to enforce any provisions of these Terms of Use or respond to a breach by me or other parties does not in any way waive Power to Decide’s right to enforce subsequently any terms or conditions of these Terms of Use or to act with respect to similar breaches.
Power to Decide may restrict, suspend, or terminate my access to Navigate without notice and in its sole discretion.
